TERMS & CONDITIONS Copyright The copyright for all paintings and commissioned work remains with Euphoria Art; the buyer is purchasing the original NOT the right to produce prints for publication. In addition all painting images used throughout the euphoriaart.co.uk website are the property of Euphoria Art. You must not use, reproduce, modify or distribute any images or any part of the images featured on euphoriaart.co.uk in any manner Existing Artwork All original artwork is subject to availability and is sold on a first come first served basis. In the unlikely event that a painting becomes unavailable after the purchase process has been completed, the unsuccessful buyer will be informed by email and a full refund will be issued. Euphoria Art reserves the right to cancel any order. Should this occur a full refund will be issued. Commissions Initial Request You are responsible for the providing of specific details in terms of subject matter, size, medium, style & technique relating to the commission provided to Euphoria Art. Euphoria Art takes no responsibility and is not liable for any damages or disappointment with the final product as a result of client error when providing information pertaining to the commission. Artistic Licence Where information in the initial request is absent Euphoria Art reserves the right to use “Artist licence” in decisions that may have a direct impact on the subject matter, size, medium, style & technique of the final commission. Such decisions are entirely at the discretion of Euphoria Art and will be deemed as accepted by you upon entering into the commission contract. Quotation Following the “Initial Request” and any resulting discussions. Euphoria Art will provide an initial quotation for the expected overall cost of the commissioned work and the approximate timescale for completion and delivery. The quotation does not constitute a contract and neither you or Euphoria Art is obligated to proceed with the commission. Costs given in the quotation are subject to change at the discretion of Euphoria Art. But will not be altered and will be regarded as fixed unless the terms are altered and agreed upon by both yourself and Euphoria. Times quoted for completion and delivery are merely approximate and Euphoria Art cannot be held responsible or liable for any costs, loss or damages that result from the commission not being completed within the quoted time. Payment Customers can pay Euphoria Art with cash, cheque or via Paypal as agreed by both you and Euphoria Art. When sending cash through the post it is at the customer’s own risk; Euphoria Art holds no responsibility for any loss of money. When in receipt of payment it shall be deemed that you have entered into a legal agreement in which Euphoria Art agrees to produce the commission work stated within the quotation for the price quoted. You are required to provide 25% of the quoted price to Euphoria Art BEFORE work will commence on the commission. The remainder will be due upon completion of the work and is prior to delivery/collection. All prices quoted are in pound sterling. Delivery Times All Euphoria Art paintings take between 3-5 working days from order to despatch. This time scale excludes weekends and Bank Holidays. Approx 24 hours after an order is placed, an e-mail will be sent detailing your exact despatch and delivery date. Please Note: Euphoria Art cannot allocate a despatch date for your order until full payment has been made. If you have not been e-mailed a despatch date within 72 hours of your full order being placed, please contact Euphoria Art to check that payment has been successful. Delivery Shipping (Mainland UK) All deliveries are made between 9am & 5pm, Monday to Friday. The parcel WILL require a signature so please ensure you choose a suitable delivery address taking this into account. If delivery is unsuccessful, the parcel will be returned to the local depot and delivery will be attempted again the next day. PLEASE NOTE Euphoria Art uses outside couriers and cannot give an exact date and time of delivery. Shipping (Worldwide) Euphoria Art does not currently accept overseas payment via the website. If you would like to purchase a painting to be delivered outside of the UK please email Euphoria Art for a delivery price quotation, stating the country for delivery and the painting you are interested in. PLEASE BE AWARE THAT EUPHORIA ART CANNOT BE HELD RESPONSIBLE FOR ANY DELIVERY DELAYS THAT OCCUR ONCE YOUR PARCEL HAS BEEN DESPATCHED, ALTHOUGH ALL EFFORTS WILL BE MADE TO AID CLIENTS IN ANSWERING THEIR CONCERNS AND CONTACTING THE COURIERS. Compensation Cover It is the buyer’s responsibility to select the correct compensation cover for delivery. There are four options of compensation to choose from: £50 is free £100 is £2.50 £250 is £12.50 £500 is £25.00 Damaged Goods During shipping if there is any noticeable damage to the packaging on arrival you must refuse to accept the item. If the item appears undamaged and you accept delivery of the item before removing the packaging, you must sign the delivery documents accompanied by the words "Unchecked". If, on unwrapping the item, damage is discovered, you must notify Euphoria Art within 24hours of receipt of any damage to the item. You must send damaged items back to Euphoria Art using an approved courier. You must include the original packaging materials in addition to returning any damaged goods. Returns/Refunds You are free to return any “Existing Artworks” or “prints” avaiable on euphoriaart.co.uk You must notify Euphoria Art within 24hours of receipt if wishing to return any item and all goods must be returned to Euphoria Art within 5 working days in perfect saleable condition. You will be responsible for return deliveries, including all delivery and insurance costs. You must return the artwork to the seller in perfect saleable condition. You must return items in their original condition in order to obtain a refund. Refunds will only be made once the items have been checked & determined to be in their original and re sellable condition by Euphoria Art. Exemptions Commissioned work is exempt from refunds / returns as agreed in the terms of the commision and cannot be returned or refunded under any circumstances. |
